MEMBERSHIP TERMS AND CONDITIONS

The Lifestyle Membership Program (Program) is conducted by trading as Leap Real Estate ABN 49 770 474 669 Trust of Level 1, 2 Drewery Place, Melbourne VIC 3001 (us, we or Leap Real Estate).

  1. In these Terms and Conditions, You means you, the tenant/renter, as specified in the applicable rental agreement to lease a home by Leap Real Estate (Rental Agreement).
  2. By completing the applicable Rental Agreement, You agree to and accept these Terms and Conditions.
  3. You are eligible to be a member of the Program if You:
    1. are a natural person and 18 years of age or over;
    2. have entered into a Rental Agreement and rented property for a period of twelve (12) months or more (for Car Prize and Leap Year only);
    3. are not in breach of the Rental Agreement or have not previously been in breach of the Rental Agreement;
    4. are a current tenant under the Rental Agreement and remain a current tenant under the Rental Agreement until the settlement of a Resimax Group House and Land Package lot;
    5. have maintained positive tenant behavior (to be determined in the absolute discretion of Leap Real Estate); and
    6. Membership to the Program has not ceased or previously been ceased. For the avoidance of doubt, if membership to the Program has ceased due to an ending of a previous Rental Agreement,
      (Eligible Member).
  4. Membership is limited to one per household. Notwithstanding this, the Leap Year Reward can be taken advantage of, subject to these conditions, one per household per year at the discretion of the member.
  5. The membership to the Program will commence on the date of Your Rental Agreement and will cease at the end of your tenancy in accordance with Your Rental Agreement, including any month-to-month tenancy on the ending of the term as set out in the Rental Agreement.
  6. Leap Real Estate accepts no liability for any Rental Agreements that failed to successfully process due to technical difficulties. Illegible and/or incomplete Rental Agreements will not be accepted.
  7. Leap Real Estate may suspend or cancel a Member’s Membership if:
    1. the Member has breached these terms and conditions or Rental Agreement; and
    2. the Promotion (as described below) is cancelled or is incapable of being conducted as reasonably anticipated.
  8. Subject to these Terms and Conditions, all applicants who enter a Rental Agreement and are an Eligible Member, go into the draw to win monthly and yearly prizes (as may be varied from time to time) and have access to a range of discounts as advertised by Leap Real Estate website and will also be eligible for the Leap Year Reward as further described below (Promotion).
  9. You acknowledge that You provide certain information to Leap Real Estate to be used by Leap Real Estate for future promotional purposes. Individual’s personal information cannot be disclosed without the individual’s consent. Personal information will be handled in accordance with the Leap Real Estate’s Privacy Policy which can be viewed online at https://www.leap.realestate/privacy-policy/.
  10. Leap Real Estate reserves the right to exercise its absolute discretion in excluding applications that it considers to be contrary to law.

PROMOTION TERMS AND CONDITIONS

For each prize draw, the following terms apply:

  1. You will not be eligible to enter the Promotion (applies to prize draws and Leap Year) unless you are a member of the Program.
  2. The Promotion will only apply to entrants who are an Eligible Member (Eligible Entry). The close date of the Promotion is 31 December 2026 subject to the terms of these Terms and Conditions.
  3. Entry to the Promotion is open during the time specified in these Terms and Conditions or as varied and put on the following website: https://www.leap.realestate/lifestyle/#.
  4. As part of the Promotion, the following prizes will be drawn (Prizes):
    1. 1 voucher for two people to stay at a hotel of Leap Real Estates choosing will be drawn randomly every six (6) months;
    2. A brand new car up to the value of approximately $23,990.00 will be drawn, by way of panel judge selection, detailed further below in these Terms and Conditions, as a final draw in the first week of October 2023. Leap Real Estate will notify Eligible Members of the exact date by September 2024 (Car Prize).
  5. As part of the Promotion, a Leap Year Reward, further detailed below, may also be rewarded.
  6. Each Prize draw will take place at Leap Real Estate offices at various times during the year. Winners of the Prizes will be notified on draw completion.

Car Prize Terms and Conditions

  1. The pre Car Prize draw will take place in August / September 2024 at Leap Real Estate Offices located at 181 Hammond Ave, Essendon Fields VIC 3041. Three (3) finalists will be drawn to be eligible to win the Car Prize. The Car Prize winner will be announced in October/November 2024 at the Leap office in Eynesbury. The exact date will be confirmed closer to the above date.
  2. The three (3) Car Prize finalists will each receive notification by email that they are a finalist in the Car Prize (Notice Email).
  3. The three (3) Car Prize finalists will all receive a $1,000 fuel voucher from a service station elected by Leap Real Estate.
  4. The three (3) Car Prize finalists will be asked to submit a short video entry sharing their renting experience with Leap Real Estate and what winning the Car Prize would mean to their life (Entry). The submission of the Entry must be completed by the date specified in the Notice Email.
  5. The three (3) Car Prize finalists will only be eligible to be in the Car Prize draw if they:
    1. are an Eligible Member as set out in point 3 of these terms and conditions;
    2. use best endeavors to attend the final Car Prize draw in person on the specified date; and
    3. grants permission to the use any images, video footage (including their Entry) or other media transmission collected at the Event to be used for transmission or advertising purposes, on any media, social media or advertising platform Leap Real Estate choose.
  6. Leap Real Estate will announce a single winner for the Car Prize out of the three (3) Car Prize finalists (at it’s absolute discretion) on the Car Prize draw date.
  7. Entry into the Promotion is automatic on the terms set out in this document. Leap Real Estate will have sole and absolute discretion as to whether to accept any entry. Leap Real Estate’s decision is final and no correspondence will be entered into.
  8. Full names (including first and last name) of the Prize Winner will be published on Leap Real Estate’s preferred publication platform such as internet, magazine or newspaper for a minimum of 28 days.
  9. Any Prizes such as gift vouchers, movie passes issued by an entity other than Leap Real Estate are subject to the terms and conditions specified by that entity.
  10. Within 28 days after each Prize draw, Leap Real Estate will notify the winner of the draw (Prize Winner) in writing and will deliver the Prize (which is redeemable after the commencement of the Rental Agreement) to the contact details provided in the Rental Agreement. If the member’s contact details change prior to the draw taking place, it is the member’s responsibility to notify Leap Real Estate in writing.

LEAP YEAR REWARD TERMS AND CONDITIONS

  1. The Leap Year Program Reward is conducted by Leap Real Estate in conjunction with Resimax Group Pty Ltd ACN 164 428 942.
  2. As part of the Promotion, the following incentive is provided to eligible tenants (Leap Year Incentive):
    1. the rental amount paid by You under the Rental Agreement for a period of twelve (12) months for any year following Your initial twelve (12) months period under their Rental Agreement (capped at a maximum of $30,000), may be awarded by Resimax Group or its associated entities, as a rebate off the due settlement monies payable by You as purchaser, under a Resimax Group House and Land Package; and
    2. Education on investing/building wealth by way of live seminars, webinars and online content. Dates to be announced.
    3. For the purpose of these terms and conditions:
      Resimax Group House and Land Package means: an off-the-plan house and land contract of sale for the purchase of a house and land package within a Resimax Group development, including but not limited to Eynesbury, Newbridge and other developments Resimax Group may complete from time to time.
  3. You are only eligible for the Leap Year Incentive if You:
    1. have entered into a valid and binding contract of sale for a Resimax Group House and Land Package (Contract);
    2. You are not in breach of, or have been in breach of the Contract; and
    3. the Contract is unconditional.
  4. You are responsible for all financing requirements and payment obligations under any Contract.
  5. If You elect to use your Leap Real Estate Incentive in accordance with these terms and conditions You must;
    1. contact your Leap Real Estate Property Manager.
    2. Leap Real Estate will review and if You have satisfied the terms and condition of the Promotion and Program, will confirm that you are eligible for the Leap Year Incentive. Once confirmed Leap Real Estate will liaise with Resimax Group Pty Ltd to issue a rebate agreement at the time of signing of the Contract.
    3. The Leap Year Incentive will be capped at a maximum of $30,000.
  6. In the event that the home owner sells the dwelling being rented by You under the Rental Agreement and You have complied with all of these terms and conditions contained in this document; if you elect to transfer to another property rented to You by Leap Real Estate, you will remain a member of the Program and eligible for the Promotion. (Lease Transfer). Your benefits will continue to accrue if you complete a Lease Transfer.
  7. In the event that You are not able to complete a Lease Transfer due to Leap Real Estate having no available stock, You will need to source other living arrangements that suits your needs. If and when a property becomes available to rent, Leap Real Estate will contact you and if You elect to transfer to this available property, you will remain a member of the Program and eligible for the Promotion. For the avoidance of doubt, your membership will stop at the time of vacating a Leap Real Estate property and will re commence when you take possession of the new available property – during this time You will not be a member of the Program and You will not be eligible for any Promotions.
  8. The property under the Rental Agreement must be property managed by Leap Real Estate Pty Ltd. No other offers by Resimax Group Pty Ltd or its channels partners will be applied to this Leap Year Offer.

OTHER TERMS AND CONDITION

  1. The Program and Promotion is governed by the laws of the state of Victoria, Australia. All other terms and conditions in the Rental Agreement apply.
  2. The Program and Promotion is personal to the tenant named in the Rental Agreement and the benefit of the Program and Promotion may not be assigned.
  3. To the extent of any inconsistency between these terms and conditions and the Rental Agreement, the Rental Agreement will prevail.
  4. The Promotion cannot be taken in conjunction with any other offer, campaign or promotion promoted by Leap Real Estate from time to time without Leap Real Estate’s prior written approval.
  5. To the extent permitted by law, Leap Real Estate and Resimax Group Pty Ltd:
    1. accepts no responsibility for any damage, loss or liabilities that may arise from an eligible Member receiving a Prize;
    2. shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) or personal injury suffered or sustained by the Member arising directly or indirectly out of or in connection with this Promotion and/or Prize, accepting or using any Prizes or the Member’s participation in this Promotion, even if Leap Real Estate has been advised of the possibility of such damages;
    3. accepts no responsibility for any variation in the value of the Prizes in the Promotion; and
    4. shall not be liable to the replacing any lost, stolen or damaged Pre-Paid Visa Cards.
  6. The Member releases and discharges Leap Real Estate and Resimax Group Pty Ltd and anyone acting on Leap Real Estate’s or Resimax Group Pty Ltd’s behalf from any claim, allegation, cause of action, proceeding, demand, debt, liability, obligation, cost or expense of any nature however it arises and whether at law, in equity, under statute or otherwise in relation to the Member failure to obtain a Prize.
  7. If, for any reason whatsoever, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of Leap Real Estate which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, Leap Real Estate reserves its right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
  8. Leap Real Estate reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Promotion for any reason if Leap Real Estate’s circumstances change.
  9. Independent financial, legal or other professional advice should be sought by the Member.
  10. These terms and conditions are governed by the laws of the state of Victoria.
  11. Any queries regarding the activation, use, operation or any other query in relation to a gift voucher must be referred to the voucher issuer.
